These Terms of Service (“Terms”) govern your access to and use of the FLY Unlimited app and related services (the “Service”). By using the Service, you agree to these Terms and the Privacy Policy.
You must be at least 16 years old to use the Service. By creating an account, you represent that you are 16 or older and can form a binding contract where you live.
You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. You agree to provide accurate information and keep it updated. We may suspend or terminate accounts that violate these Terms, our policies, or that pose risk to the community or Service.
The Service is a social network. Posts are public by default. Do not post sensitive personal information you do not want to be public.
You own the content you create and upload (“User Content”). You grant FLY a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting and technical delivery), display, distribute, and otherwise use your User Content only as necessary to operate, provide, and improve the Service and to make your content available to others consistent with your settings and the Service’s functionality.
You represent and warrant that you have the rights to post your User Content and that it does not violate law or the rights of others.
You may not use the Service to post, share, transmit, or promote content or conduct that is unlawful, abusive, harmful, fraudulent, infringing, or otherwise inconsistent with a safe community environment.

We may remove content or restrict accounts that violate these Terms or otherwise create risk for users or the Service.
We provide tools to report and block users/content. Reports are reviewed manually at this time. We may remove content and take enforcement actions (including warnings, feature limits, suspension, or termination) if we believe there is a violation of these Terms or risk to users or the Service.
Direct messages are intended to be private between users. You are responsible for your messages and interactions. We may review messages if needed to investigate reports, enforce these Terms, prevent harm, or comply with legal obligations.
Payments and payouts are processed through Stripe. By using payment or payout features, you agree to comply with applicable payment processor terms and provide accurate information required for processing, verification, and compliance.
Payments on the Service relate to real-world/offline services arranged through the Service. Users may exchange information and documents inside the app to facilitate those offline services. The Service does not sell digital goods for in-app consumption.
By selecting a candidate or otherwise initiating payment, you authorize FLY and its payment processor to charge your selected payment method in accordance with the pricing and settlement flow for the applicable FLY.
Fixed-price FLYs. You authorize an initial charge equal to 50% of the total fixed price at candidate selection. Upon approval of a submitted FLY, you authorize a final charge for the remaining 50% of the total fixed price.
Hourly FLYs. You authorize an initial charge equal to 50% of the estimated total at candidate selection, based on the posted hourly rate and estimated hours. Upon approval of a submitted FLY, you authorize final settlement based on the actual total hours multiplied by the applicable hourly rate. Depending on the final total and amounts already paid, this may result in an additional charge or an applicable refund or credit.
You also authorize FLY to process related payment adjustments, reversals, refunds, or corrections where reasonably necessary to complete the transaction, resolve disputes, prevent fraud, or comply with legal or payment processor requirements.
Refunds are decided on a review basis. If a FLY is not accepted or is otherwise eligible under our review, we provide a strict refund of 85% of eligible amounts paid. Up to 15% may be retained to cover payment processing costs, administrative handling, and fraud prevention.
If you receive payouts, transfers may be subject to verification, delays, reserves, and compliance requirements. You are responsible for any taxes or reporting obligations related to payments or payouts.
The Service and its content (excluding your User Content), including software, design, and branding, are owned by FLY and its licensors. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service except as permitted by law.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if your use creates risk or legal exposure for FLY or others.
The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, FLY will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses. To the maximum extent permitted by law, FLY’s total liability for claims relating to the Service will not exceed the amount you paid to FLY through the Service in the three (3) months before the event giving rise to the claim, or $100 USD if you paid nothing.
You agree to indemnify and hold harmless FLY and its officers, directors, employees, and agents from claims arising from your use of the Service, your User Content, or your violation of these Terms.
These Terms are governed by the laws of Delaware, excluding conflict-of-law rules.
We may update these Terms from time to time. We will update the effective date when changes are made. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
